You can use a trade mark to protect a product or company name, a logo, a slogan or another distinctive sign against imitation.

The Patent Office does not check whether an identical or similar trade mark has already been registered. We therefore recommend carrying out a professional trade mark search before applying for a trade mark and having the search results legally assessed with regard to a possible trade mark conflict. This can reduce the risk of an expensive trade mark infringement.

It may take several months before the trade mark is entered in the trade mark register. As trade mark protection only comes into effect upon registration, we recommend applying for trade mark protection before the trade mark is used. However, it is still possible to apply for trade mark protection even if the trade mark is already in use.

The term of protection of a trade mark is 10 years and can be extended as often as required.
